Coverage requierements

Employers conducting work in the State of Florida are obligated to provide workers' compensation insurance for their employees. The specific coverage requirements depend on factors such as the type of industry, the number of employees, and the entity organization. The Bureau of Compliance provides the following information to determine coverage requirements for a specific employer:

Construction
Industry

Contruction Industry

Employers in the construction industry, including corporate officers or Limited Liability Company (LLC) members who are owners of the business, must have workers' compensation coverage, even if there is only one employee. The Florida Administrative Code (69L-6.021) provides a list of trades considered to be in the construction industry.

Non-Construction
Industry

Non-Contruction Industry

Employers in non-construction industries must have workers' compensation coverage if they have four (4) or more employees, including corporate officers or LLC members who are business owners. Sole proprietors or partners in a partnership in the non-construction industry are not considered employees unless they choose to be included on the business's Workers' Compensation Insurance policy by filing a form DWC-251 with the Division of Workers' Compensation.

Agricultural

Agricultural Industry

Employers in the agricultural industry must have workers' compensation coverage if they have six (6) regular employees and/or twelve (12) seasonal workers who work more than 30 days during a season, but no more than a total of 45 days in a calendar year.

Out-of-State Employers

Out-of-state employers in Florida must follow regulations: notify their insurer about working there, obtain a Florida Workers' Compensation Insurance policy if uninsured, meeting state requirements. The policy should specify "Florida" in Section 3A. Some may temporarily use their home state's policy via an Extraterritorial Reciprocity clause.

Contractors must ensure subcontractors have Workers' Compensation Insurance before starting a project, per workers' compensation regulations. The Florida Administrative Code (69L-6.032) specifies required subcontractor documentation. If subcontractors lack insurance, the contractor becomes responsible for their workers, including providing benefits for work-related incidents like injuries, illnesses, or fatalities.
